KWMC partner, Patrick Shelley, obtained a directed verdict in favor of our client, a reproductive endocrinologist (fertility specialist), in a medical malpractice action. The parent-plaintiffs commenced a “wrongful birth” case, alleging that had they known of the risk of giving birth to a child with a genetic disorder, they would have terminated the pregnancy and, therefore, not incurred the “extraordinary” expenses of raising the disabled child to the age of majority. The defense argued that the standard of care was met, in that no additional genetic screening was required after one parent tested negative from the standard panel testing, while it was also argued that plaintiff failed to prove to have incurred any “extraordinary” expenses relating to the child’s disability. On October 2, 2026, the Hon. Conrad Singer (Supreme Court, Nassau County) issued a directed verdict in favor of the defendants, dismissing this case in its entirety.
