KWMC partner, Timothy Shelley, was successful in a motion for summary judgment in a premises liability case venued in Kings County. Plaintiff, while delivering products to our client’s retail store, claimed that he slipped and fell down sidewalk vault steps due to the presence of snow/ice, causing injuries to his back and neck. Per the decision of the Hon. Wayne Saitta, dated January 22, 2025, the defendant made a showing that there was a “storm in progress” at the time of the incident and, as such, defendant was not under a duty to remove the accumulated snow/ice. As such, plaintiff’s complaint was dismissed in its entirety.
