Summary Judgment Obtained by Timothy Shelley

KWMC partner, Timothy Shelley, was successful in a motion for summary judgment in a premises liability case venued in Suffolk County.  Plaintiff alleged that, while entering defendant’s grocery store, he was caused to suffer various injuries due to a malfunctioning automatic door upon entry to the store.  Per the decision of the Hon. Frank A. Tinari, dated September 3, 2024, as the defendant made a showing that it was not on notice of the alleged malfunctioning door prior to the incident, summary judgment was warranted, dismissing all claims.
