KWMC partner, Stephen Rach, obtained a directed verdict, resulting in dismissal of all claims against our hospital client, in a medical malpractice action in the Supreme Court, Suffolk County. Plaintiff alleged that two emergency departments, and their respective physicians, failed to consider, or diagnose, an evolving stroke. During voir dire of the plaintiff’s neurology expert, it was established that the expert did not possess the requisite knowledge, experience, or training necessary to establish the standard of care applicable to the defendant emergency room physicians and hospitals. The defendants moved to preclude the expert from offering opinions as to the applicable standard of care, which was granted by the Hon. Joseph Farnetti on September 13, 2023, resulting in the dismissal of this case in its entirety.
