KWMC partner, Robert Lapping, obtained a defense verdict on behalf of our hospital client in a medical malpractice action. The 68 year-old male plaintiff, with multiple comorbidities, presented to the hospital with a benign, but growing brain tumor that had not been followed since diagnosis years earlier, and was now symptomatic, requiring surgical removal. He “woke up” very slowly following surgery, taking a week and a half to become conversant, and requiring reintubation for significant periods. The plaintiff then went downhill and expired a month following surgery. It was claimed that plaintiff was not monitored appropriately during his transfer from the OR to the recovery room, and he suffered brain damage as a result. The Suffolk County jury, before the Hon. Joseph Santorelli, returned a verdict on behalf of the defendants on September 29, 2023, dismissing this case in its entirety.
