KWMC partner, Stephanie Johnston, was successful in a motion for summary judgment in a medical malpractice case venued in Queens Supreme Court. Plaintiff-decedent alleged defendant was negligent in failing to properly treat a urinary tract infection leading to urosepsis. There were separate claims involving the failure to properly prevent, diagnose and treat pressure ulcers. Judge Catapano-Fox, in an order dated March 12, 2026, granted summary judgment as to our geriatrician/internal medicine client, as we established that that the plaintiff-decedent was not suffering from a urinary tract infection upon transfer to the hospital from the nursing home, based on multiple urine cultures that showed no growth. We also established that our client had no involvement in diagnosing, assessing or recommending treatment for pressure ulcers while the decedent was in the hospital, warranting dismissal of all claims.
