We would like to congratulate Stephen E. Rach II, Partner, for obtaining a defense verdict in a recent medical malpractice case in Supreme Court, Suffolk County before Hon. W. Gerard Asher. Mr. Rach represented a cardiologist who the plaintiff claimed failed to properly diagnose a coronary issue and prevent his heart attack. The plaintiff claimed to suffer cognitive deficits as a result of the duration of his emergency code and the medically induced coma that followed. The jury concluded that not only could our client not have prevented the plaintiff’s heart attack, but that the plaintiff’s failure to quit smoking, despite our client urging him to do so, played a significant role in causing his alleged injuries.
