KWMC partner, Timothy Shelley, was successful in a motion for summary judgment in a premises liability case venued in Kings County. Plaintiff, while ascending a concrete ramp to enter the residential building owned by the defendant, alleges he slipped and fell on a patch of ice. Per the decision of the Hon. Richard J. Montelione, dated June 5, 2024, the defendant made a showing that it was not on notice of the alleged ice condition prior to the time of the accident, warranting dismissal of all claims.
