As featured in the NY Law Journal’s decision of the day on January 30, 2025, KWMC partner, Timothy Shelley, was successful in a motion for summary judgment in a NY Labor Law case venued in Kings County. Plaintiff, alleging violations of NY Labor Law Sections 240(1) and 241(6), claimed that, while installing a temporary perimeter fencing around a construction site in the Bronx, a 70 pound post driver “popped off” the top of a fence post, falling down onto his head/neck. Per the decision of the Hon. Aaron D. Maslow, dated January 26, 2025, the defendant made a showing that the incident at issue did not fall within the ambit of the Labor Law, warranting dismissal of all claims.
