KWMC associate, Stephanie Johnston, was successful in a motion for summary judgment on behalf of a landlord and commercial tenant in a premises liability case venued in Nassau County. The plaintiff claimed that she tripped and fell on a piece of metal that was not completely removed from an old traffic sign. Per the Order of the Hon. Sarika Kapoor, dated December 4, 2023, the court found that the landlord and commercial tenant were not responsible to maintain, remove or repair a traffic sign, which was the sole responsibility of the municipality. Plaintiff’s counsel subsequently moved for leave to reargue the summary judgment decision, which was denied.
