KWMC associate, Argie Drakos, was successful in a motion for summary judgment in a medical malpractice case venued in Kings County. Plaintiff alleged that the defendant failed to timely diagnose and/or properly treat pressure ulcers and failed to diagnose an infection during the decedent’s stay at the defendant hospital. The Court agreed with the defendants that the plaintiff’s expert failed to rebut the assertions made on behalf of our expert, while additional opinions set forth by plaintiff’s expert were new theories of liability, improperly raised/claimed for the first time in opposition to our motion. In an Order dated May 24, 2024, Justice Genine D. Edwards dismissed this action in its entirety.
