KWMC partner, Argie Drakos, was successful in a motion for summary judgment in a medical malpractice case venued in Bronx County. Plaintiff claimed he was exhibiting signs and symptoms of a urinary tract infection at the time of a cystoscopy, which was not properly diagnosed, leading to urosepsis and sepsis induced cardiomyopathy. Justice Alicia Gerez, in an Order dated April 15, 2025, found that the defendants satisfied their burden by providing expert opinions refuting plaintiff’s essential allegations of malpractice and proximate cause and that, in opposition, plaintiff failed to properly rebut defendants showing of entitlement to summary judgment, warranting dismissal of the case in its entirety.
