KWMC senior associate, Jonathan Janofsky, was successful in motion for summary judgment in a medical malpractice case venued in Queens Supreme.  Plaintiff claimed that the defendant, a pain management physician, improperly performed a ganglion impar block to treat pain in the coccyx area of the lower back, resulting in a baseball sized swollen area in her lower back that is permanent in nature.  Judge Tracy Catapano-Fox, in an Order dated May 21, 2025, found that the defendants satisfied their burden by providing expert opinions refuting plaintiff’s essential allegations of malpractice and proximate cause.  Defendants established that a new MRI was not necessary because plaintiff’s condition was diagnosable via prior imaging studies, the ganglion impar block was appropriately performed, and nothing the defendant did caused plaintiff’s coccyx bone bruise.  In opposition, plaintiff failed to properly rebut defendants showing of entitlement to summary judgment, warranting dismissal of the case in its entirety.
