Congratulations to KWMC’s Kerri Levy for obtaining a defense verdict on behalf of a nurse in the Supreme Court, Suffolk County on July 17, 2023. Plaintiff alleged that the defendant nurse deviated from accepted nursing practice in the manner and location she placed an IV catheter being used for an MRI study with gadolinium contrast. A novel causation theory was put forth before the jury that the extravasation of gadolinium contrast caused a systemic progressive fibrosing disorder despite the plaintiff having normal kidney function. At trial, it was established that there were no departures nor was there a causally related injury. The jury unanimously decided there were no departures from the standard of care.
